UTILITYDOG TERMS AND CONDITIONS

1. Acceptance of Terms
Welcome to Utilitydog! By enrolling in or participating in any of our dog training or day training services, you agree to abide by the following Terms and Conditions. These terms constitute a legally binding agreement between you (“the Client”) and Utilitydog (“UDK9”, “we”, “us”, “our”).
Please read them carefully before proceeding.
2. Services Offered
Utilitydog provides a range of dog training services including, but not limited to:
Group classes and workshops
Private lessons in public
Private lessons at facility
Day training at facility
Scent detection and protection sports classes
Behavioural modification and enrichment activities
All services are conducted by experienced trainers to improve communication, control, and confidence between dogs and their owners.
3. Booking and Cancellation Policy
3.1 Booking
Bookings can be made in person, via phone, or through our online system. By booking, you confirm that you have read, understood, and accepted these Terms and Conditions.
3.2 Cancellation
If you need to cancel or reschedule a session, we require a minimum of 24 hours’ notice. Cancellations made with less than 24 hours’ notice will result in forfeiture of the session fee.
4. Liability Waiver and Assumption of Risk
4.1 General Acknowledgement
Dog training, exercise, and handling inherently involve physical activity, environmental exposure, and interactions with animals that can be unpredictable. By engaging with Utilitydog’s services, you voluntarily assume all risks of injury, illness, or damage to yourself, your dog, or any property.
4.2 Release of Liability
You hereby release, waive, and forever discharge Utilitydog, its owners, employees, contractors, representatives, and agents from any and all claims, demands, actions, or causes of action arising from or related to:
Injury, illness, escape, loss, or death of your dog;
Injury, illness, or damage sustained by any person or animal;
Damage to property;
whether occurring on or off the premises, during training sessions, at pick-up or drop-off, or during transportation.
4.3 Indemnification
You agree to indemnify, defend, and hold harmless Utilitydog and its representatives against all claims, damages, costs, or expenses (including legal fees) arising from your participation or your dog’s actions.
5. Day Training, Facility, and Transportation Liability
5.1 Facility Disclaimer
All day training and group class services take place at 4/237 Petrie Creek Road, Rosemount, QLD, 4560 (“the Facility”). While every reasonable precaution is taken to ensure safety, you acknowledge that Utilitydog is not responsible for any injury, accident, illness, escape, or death that may occur to your dog or any person within or around the Facility. Except in cases of proven negligence.
5.2 Pick-Up and Drop-Off
Utilitydog may provide pick-up and drop-off services to designated locations. You acknowledge and accept that:
The transfer of dogs between handlers and vehicles carries inherent risk.
Utilitydog and its representatives are not liable for any incident, injury, or accident occurring during pick-up, drop-off, or while dogs are in transition between vehicles, gates, or public areas.
You are responsible for ensuring your dog is secure, accessible, and fit for travel at the designated times.
5.3 Transportation
If Utilitydog transports your dog (to or from the Facility or any other training location), you acknowledge and agree that:
All transportation is undertaken at your own risk.
Utilitydog accepts no liability for accidents, injuries, illnesses, escapes, or death occurring during transport due to vehicle incidents, sudden health events, or unforeseeable circumstances.
6. Health, Safety, and Sudden Incidents
6.1 Dog Health
By participating, you confirm that your dog is in good physical health, free of contagious diseases, and current on all vaccinations and parasite preventatives.
6.2 Emergencies and Sudden Illness or Death
While every reasonable effort is made to monitor and safeguard dogs, you understand that sudden illness or death (e.g., cardiac arrest, heat stroke, internal complications) can occur without warning.
You agree that:
Utilitydog shall not be held responsible for any death, injury, or medical event that occurs without negligence.
In the event of a medical emergency, we will make reasonable efforts to contact you and/or your nominated veterinarian.
You are responsible for all veterinary costs incurred during or as a result of any emergency.
6.3 Aggressive or Unsafe Behaviour
Dogs displaying aggression or unsafe behaviour may be removed from activities at Utilitydog’s discretion. The Client remains responsible for all associated costs and liabilities.
7. Photography and Promotion
You grant Utilitydog permission to photograph, film, or otherwise record your dog during training or day care activities for educational or promotional purposes. Such materials may be used on our website, social media, or marketing platforms without further consent or compensation.
8. Limitation of Liability
To the fullest extent permitted by law, Utilitydog’s total liability for any claim, loss, or damage (whether in contract, tort, or otherwise) shall not exceed the total amount paid for the service in question.
Under no circumstances shall Utilitydog be liable for any indirect, incidental, or consequential damages, including emotional distress, loss of income, or veterinary costs beyond those caused by proven negligence.
9. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of Queensland, Australia.
Any dispute shall be resolved exclusively within the jurisdiction of the Queensland courts.
10. Acknowledgment
By enrolling in Utilitydog’s services, you acknowledge that you have:
Read, understood, and agreed to these Terms and Conditions;
Been advised of the inherent risks involved in training, transport, and animal handling;
Released Utilitydog from all liability except in cases of proven negligence.
